Опасность признания Украиной свидетельств «Л/ДНР» о рождении и смерти
Кабинет министров Украины принял решение о признании свидетельств о рождении и смерти, выданных на оккупированной части Донбасса. Какую опасность это несет для Украины?
На территории ОРДЛО сейчас находится значительное количество российских наемников, спецслужб и тому подобное. И на территории ОРДЛО также находятся базы украинских паспортов умерших, тех, кто выехал или пропал без вести, поэтому, за мертвых людей можно спокойно выдавать нужных российской оккупационной администрации персонажей. А следующим шагом станет вопрос выборов … Если Украина признает свидетельства ОРДЛО о рождении и смерти, то соответственно признает и документы о гражданстве, то есть украинские паспорта, которые были выданы до войны, которые потом окажутся поддельными или в какой-то другой способ полученные.
Поэтому в признании справок о смерти или рождения есть определенный риск того, что это будет иметь продолжение в идентификации или в том, что мы получим людей, документы которых можно будет поставить под сомнение.
Второй риск связан с тем, на каких бланках будут оформлены эти документы. ОРДЛО будет подчеркивать, что у них есть так называемые «герб», «гербовые печати» и бланки, где указаны органы «ЛНР» и «ДНР». Именно такие документы, согласно решению Кабмина, будут признаваться на территории, подконтрольной Украине. И это означает, что это – первый шаг к признанию этих оккупационных администраций субъектом.
Здесь вопрос не в том, что это – позиция «партии войны», или это каким-то образом дискриминирует граждан, проживающих на оккупированных территориях … Если мы пойдем по пути признания таких документов, это может создать дополнительные возможности для дальнейшего «впихивания» в Украину ОРДЛО как субъекта.
Справки с «гербовыми печатями» «Л/ДНР» не могут быть признанными в Украине, поскольку мы не признаем ту сторону как субъект. Это должно быть четко прописано, должна быть выписана понятная для граждан процедура получения признания документов, выданных в ОРДЛО. Но все равно этот риск может оказаться неоправданным. Не стоит спешить признавать эти справки на государственном уровне путем принятия дополнительных документов или инструкций.
«Л/ДНР» благодаря такому решению Киева получат возможность манипулировать количеством умерших. Ведь здесь никто не знает, сколько свидетельств о смерти они могут нарисовать, зато русская оккупационная власть сможет показывать, «сколько людей убивает «киевская хунта»».
Кроме того, «ЛНР» и «ДНР» инициировали перепись населения на своих территориях, и результаты они активно будут использовать для манипуляций, в частности, для обвинении украинцев в геноциде или еще в чем-то.
Что же делать, например, в случае рождения ребенка на территории ОРДЛО? В таком случае, как правило, родители получают свидетельство о рождении установленного образца там, на оккупированной территории, а потом с ним приезжают в Украину и здесь его нострификуют – получают копию в украинских органах власти, а именно в органах, фиксирующих акты гражданского состояния. В принципе, у нас на это закрывали глаза: люди показывали ту справку – и им выписывали украинского образца. Но все это делалось за взятки или по доброте душевной, понимая, что другого способа нет.
Известно, что в отдельных регионах Украины в 2016-2018 годах принимали документы, выданные в ОРДЛО, в частности, справки о смерти. Люди не могли доказать, что человек умер и единственной справкой об этом была справка, выданная каким-либо “горисполкомом” или “городской администрацией” на оккупированной территории. До сих пор справки о смерти и рождения для граждан с ОРДЛО в Украине выдавались через суд. Это было дополнительной нагрузкой на суды, но это и была форма.
В идеале, должна быть четко прописаная процедура нострификации, где бы ясно говорилось, кто должен выдавать эти справки о рождении и смерти, насколько они соответствуют всем требованиям, насколько эти справки соответствуют реальности, то есть не являются ли они поддельными … Это должна делать специальная комиссия.
Кроме того, не стоит надеяться, что такой шаг будет способствовать исчезновению махинаций с пенсиями, в частности, попыток получить две пенсии. Ведь такое решение никоим образом не предусматривает обмена базами данных. Никто эти базы нам не даст.
Поэтому никакой пользы для Украины от этой идеи нет. Мы не можем проконтролировать, кто выдает эти справки или свидетельства и кому.
Пока не будет должного контроля над органами, которые будут выдавать эти справки в ОРДЛО, мы не должны признавать их.
