Что нужно знать украинцам о Законе Украины «Об обеспечении функционирования украинского языка как государственного»
Много дискуссий ходит вокруг нашумевшего Закона Украины «Об обеспечении функционирования украинского языка как государственного». И, как говорится, сколько людей столько и мнений. Стоит напомнить, что этот Закон вступил в законную силу 16 июля 2019 года. Как следствие, сразу же активизировались пророссийские тролли, которым дай только повод чтобы «раскачать» ситуацию внутри нашего государства. Да, действительно, есть определённая недосказанность между населением, проживающим в разных регионах Украины. Но мы решили, как говориться, не гадать, а обратиться за разъяснениями в компетентные организации. В Министерстве культуры Украины озвучили, что кардинальных изменений со вступлением в силу Закона не произошло, но эта дата стала стартом для внедрения изменений, которое будет происходить на протяжении нескольких лет. Нормы закона будут вступать в силу постепенно, начиная с 2020 года и заканчивая 2030 годом.
Прежде всего стоит отметить два важных момента:
– согласно ч.2 ст.2 Закона: действие этого Закона не распространяется на сферу частного общения и осуществления религиозных обрядов;
– согласно ч.3 ст.2 Закона: порядок применения крымскотатарского и других языков коренных народов, национальных меньшинств Украины в соответствующих сферах общественной жизни определяется законом о порядке реализации прав коренных народов, национальных меньшинств Украины с учётом особенностей, определённых настоящим законом.
Норма закона, которая вызвала самый большой резонанс в обществе, которую так же считали дискриминационной и «фашистской» касается образовательной сферы (ст.21). Стоит отметить, что она только дублирует ст.7 Закона Украины «Об образовании», который в Украине действовал и до текущего времени.
Согласно этой статьи, внешнее независимое оценивание должно проводиться на государственном языке, кроме оценивания иностранных языков. Эта норма вступит в силу только в 2030 году. И напоследок хотелось бы выяснить то, что якобы за нарушение этого Закона будут сажать в тюрьму. На этот вопрос эксперты в области права разъяснили, что за нарушение норм этого Закона граждан Украины ожидает административная ответственность.
Изменения, внесённые в КУоАП вступят в силу только с 16 июля 2022 года.
